representa\u00e7\u00e3o para que o Minist\u00e9rio P\u00fablico do Estado de S\u00e3o Paulo pe\u00e7a a suspens\u00e3o de uma mudan\u00e7a introduzida pela&nbsp;<a href=\"https:\/\/www.saopaulo.sp.leg.br\/zoneamento2023\/\" target=\"_blank\" rel=\"noreferrer noopener\" style=\"background-color: transparent;font-weight: bold\">nova lei de zoneamento<\/a>, sancionada em janeiro pelo prefeito de S\u00e3o Paulo, Ricardo Nunes. Pedimos, especificamente, que seja invalidada a medida que permite pr\u00e9dios maiores na Marginal Pinheiros entre as avenidas Arruda Botelho e Frederico Hermann Jr.<\/span><\/p>\n<p style=\"text-align: justify;margin: 0px 0px 10px;line-height: 1.5\"><span style=\"font-size: 18px;font-family: Arial, Helvetica, sans-serif\">A representa\u00e7\u00e3o protocolada junto ao procurador-geral solicita que o MP entre com uma a\u00e7\u00e3o direta de inconstitucionalidade, com pedido de medida liminar \u2014 ou seja, de efeito imediato .<\/span><\/p>\n<p style=\"text-align: justify;margin: 0px 0px 10px;line-height: 1.5\"><span style=\"font-size: 18px;font-family: Arial, Helvetica, sans-serif\">Veja abaixo os argumentos apresentados pela SAAP.<\/span><\/p>\n<p class=\"has-medium-font-size\" style=\"text-align: justify;margin: 0px 0px 10px;line-height: 1.5\"><strong><span style=\"font-size: 18px;font-family: Arial, Helvetica, sans-serif\">A mudan\u00e7a \u00e9 ilegal porque fere princ\u00edpios do zoneamento<\/span><\/strong><\/p>\n<p style=\"text-align: justify;margin: 0px 0px 10px;line-height: 1.5\"><span style=\"font-size: 18px;font-family: Arial, Helvetica, sans-serif\">O mapa de zoneamento alterado pela nova lei transforma aquele trecho da Marginal Pinheiros em zona de centralidade. Ou seja, uma \u00e1rea destinada \u201c\u00e0 promo\u00e7\u00e3o de atividades t\u00edpicas de \u00e1reas centrais ou de subcentros regionais ou de bairros, destinadas principalmente aos usos n\u00e3o residenciais, com densidades construtiva e demogr\u00e1fica m\u00e9dias\u201d, como definido em lei. Nesse tipo de zona s\u00e3o permitidos, por exemplo, pr\u00e9dios de at\u00e9 48 metros de altura.<\/span><\/p>\n<p style=\"text-align: justify;margin: 0px 0px 10px;line-height: 1.5\"><span style=\"font-size: 18px;font-family: Arial, Helvetica, sans-serif\">S\u00f3 que isso \u00e9 incompat\u00edvel com a vizinhan\u00e7a: praticamente todos os demais lados das quadras nesse trecho da Marginal s\u00e3o zonas exclusivamente residenciais (ZER 1). Isso significa que s\u00e3o \u00e1reas \u201cde baixa densidade construtiva e demogr\u00e1fica\u201d e com \u201cn\u00edveis de ru\u00eddo compat\u00edveis com o uso exclusivamente residencial e com vias de tr\u00e1fego leve e local\u201d. N\u00e3o faz sentido pr\u00e9dios de 48 metros de altura serem vizinhos de resid\u00eancias.<\/span><\/p>\n<p style=\"text-align: justify;margin: 0px 0px 10px;line-height: 1.5\"><span style=\"font-size: 18px;font-family: Arial, Helvetica, sans-serif\">O que faz sentido \u00e9 a classifica\u00e7\u00e3o da lei anterior: o trecho da Marginal Pinheiros era uma zona corredor 2, ou seja, destinada \u201c\u00e0 diversifica\u00e7\u00e3o de usos de forma compat\u00edvel \u00e0 vizinhan\u00e7a residencial e \u00e0 conforma\u00e7\u00e3o de subcentro regional\u201d. Nesse tipo de uso, os pr\u00e9dios podem ter altura m\u00e1xima de 10 metros, por exemplo. N\u00e3o foi mencionado nas diversas audi\u00eancias p\u00fablicas que debateram o texto do prefeito. N\u00e3o estava na&nbsp;<a href=\"http:\/\/www.saap.org.br\/zoneamento\/texto-do-relator-mantem-zoneamentos-de-alto-dos-pinheiros-e-reduz-altura-dos-predios-do-entorno\/\" target=\"_blank\" rel=\"noreferrer noopener\" style=\"background-color: transparent;font-weight: bold\">primeira vers\u00e3o do relator do projeto<\/a>&nbsp;na C\u00e2mara. N\u00e3o estava no&nbsp;<a href=\"https:\/\/www.instagram.com\/p\/C02ub3Ysb1a\/?utm_source=ig_web_copy_link&amp;igsh=MzRlODBiNWFlZA==\" target=\"_blank\" rel=\"noreferrer noopener\" style=\"background-color: transparent;font-weight: bold\">projeto aprovado em primeira vota\u00e7\u00e3o<\/a>&nbsp;pelos vereadores.<\/span><\/span><\/p>\n<p style=\"text-align: justify;margin: 0px 0px 10px;line-height: 1.5\"><span style=\"font-family: Arial, Helvetica, sans-serif\"><span style=\"font-size: 18px\">Ela s\u00f3 entrou na \u00faltima hora, no dia da segunda e \u00faltima vota\u00e7\u00e3o. Isso ocorreu por meio de uma&nbsp;<a href=\"https:\/\/splegisconsulta.saopaulo.sp.leg.br\/Pesquisa\/DetailsDetalhado?COD_MTRA_LEGL=1&amp;COD_PCSS_CMSP=586&amp;ANO_PCSS_CMSP=2023\" target=\"_blank\" rel=\"noreferrer noopener\" style=\"background-color: transparent;font-weight: bold\">emenda<\/a>&nbsp;apresentada pelo vereador Isac F\u00e9lix, que faz parte da bancada evang\u00e9lica. N\u00e3o por acaso, os&nbsp;<a href=\"https:\/\/splegisconsulta.saopaulo.sp.leg.br\/Home\/AbrirDocumento?pID=505780\" target=\"_blank\" rel=\"noreferrer noopener\" style=\"background-color: transparent;font-weight: bold\">documentos<\/a>&nbsp;que ilustram a mudan\u00e7a trazem o nome da&nbsp;<a href=\"https:\/\/www.ippinheiros.org.br\/\" target=\"_blank\" rel=\"noreferrer noopener\" style=\"background-color: transparent;font-weight: bold\">Igreja Presbiteriana<\/a>, institui\u00e7\u00e3o que j\u00e1 h\u00e1 alguns anos planeja expandir seus im\u00f3veis em Alto dos Pinheiros e que se beneficia da altera\u00e7\u00e3o.<\/span><\/span><\/p>\n<p style=\"text-align: justify;margin: 0px 0px 10px\"><span style=\"font-family: Arial, Helvetica, sans-serif\"><span style=\"font-size: 18px\">Como observa a representa\u00e7\u00e3o da SAAP, \u201ctratando-se de emenda que foi apresentada e aprovada no mesmo dia, evidentemente n\u00e3o se submeteu a an\u00e1lises t\u00e9cnicas, nem foi objeto de debates junto a representantes da sociedade civil\u201d.
